In Virginia, what might appear to a non-resident as a simple speeding violation may actually be a charge of reckless driving, which is a class one misdemeanor.

In Virginia, any speed 20 mph over the posted speed limit is considered reckless driving and any speed over 80 mph, regardless of the posted speed, even in a 65 mph or 70 mph zone is reckless driving.

Reckless driving by speed alone is considered a criminal offense and carries a maximum of 12 months jail, a $2,500 fine and license suspension.
